Welcome

These terms govern your use of HostUnited's hosting services. By creating an account or using any of our services, you agree to these terms. We've written them in plain language because we believe clarity builds trust. If anything is unclear, please reach out — we're always happy to help.

These terms apply to all visitors, registered members, and paying customers. If you're accepting on behalf of an organization, you represent that you have authority to bind that entity to these terms.

What We Provide

HostUnited offers cloud server hosting with managed infrastructure, including virtual servers, storage, networking, automated backups, and DDoS protection. We continuously maintain and improve our infrastructure to ensure your services run smoothly and securely.

Service specifications — compute resources, storage, bandwidth, and features — are described on our website and in the client portal. We may update, add, or retire features with reasonable advance notice. While we aim for broad compatibility, it's your responsibility to confirm our services work with your specific requirements.

Your Account

When you register, please provide accurate and complete information. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, let us know immediately so we can help secure your account.

We strongly encourage enabling two-factor authentication for added security. Accounts may not be shared or transferred to another party without our prior written consent. We may temporarily suspend accounts we reasonably believe have been compromised to protect your data.

Responsible Use

We ask that you treat shared resources with respect — just as you'd treat any community space. Our services may not be used for any of the following:

  • Distributing malware, phishing kits, or exploit tools
  • Launching attacks against other systems or networks
  • Hosting illegal content or content that promotes hatred or violence
  • Sending unsolicited bulk communications (spam)
  • Cryptocurrency mining without prior written authorization
  • Port scanning or probing third-party networks
  • Running processes that degrade service quality for other members
  • Circumventing security controls or resource limits

We reserve the right to suspend services that violate these principles, and we'll always try to notify you first unless the situation demands immediate action.

Availability Promise

We commit to 99.99% uptime for our infrastructure. If we fall short due to unscheduled downtime, you'll receive service credits proportional to the disruption. Scheduled maintenance windows are communicated at least 48 hours in advance and are not counted against our uptime commitment.

Credit tiers: 99.9%–99.99% uptime earns a 10% credit; 99.0%–99.9% earns a 25% credit; below 99.0% earns a 50% credit. Maximum credit is 50% of the monthly fee for the affected service. Credits are applied to your account balance and are not refundable as cash. Submit credit requests within 30 days of the incident.

This commitment does not cover disruptions caused by force majeure, customer-initiated actions, or third-party service failures outside our infrastructure.

Payments

Services are billed monthly in USD. Invoices are generated at the start of each billing cycle and payment is due within 14 days. We accept major credit cards and other payment methods available through our billing portal. If a payment is overdue, we'll send reminders before taking any action on your services.

Overdue accounts accrue interest at 1.5% per month or the legal maximum, whichever is lower. Services may be suspended after 7 days of non-payment. Price changes are communicated at least 30 days in advance and apply at the next billing cycle. If you cancel, you'll receive a prorated refund for unused time. You're responsible for applicable taxes and duties.

Data Care

Your data is stored exclusively in European data centers. We are fully GDPR compliant and employ encryption both at rest and in transit. We do not access, analyze, or share your data unless required by law or with your explicit consent. Your data belongs to you — always.

As your data processor, we handle data only as you instruct. A Data Processing Agreement (DPA) is available on request. We use AES-256 encryption at rest and TLS 1.3 in transit. We perform regular security audits and will notify you of any data breach within 72 hours as required by GDPR. You can exercise your data rights — access, rectification, erasure, portability — at any time through our support team.

Intellectual Property

The HostUnited platform, branding, software, APIs, and documentation are the property of HostUnited or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our platform without permission.

Your content and data remain entirely yours. We have a limited license to host and process your content solely to provide the services you've subscribed to. This license ends when your account is closed. Nothing in these terms transfers your intellectual property to us.

Liability

Our total liability for any claims arising from or related to these terms or your use of our services is limited to the total fees you have paid to HostUnited in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss beyond what is covered by our backup services.

We're not responsible for failures caused by force majeure events, third-party service disruptions, or actions you take on your own services. This limitation applies to the fullest extent permitted by the laws of the Netherlands, regardless of the legal theory.

Indemnification

You agree to indemnify and hold harmless HostUnited, its team, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of HostUnited services or activity under your account
  • Your breach of these terms or any applicable law
  • Infringement of third-party rights through your content or applications
  • Content you store, transmit, or distribute through our platform

This obligation continues even after your account is closed or these terms end.

Third-Party Services

Our platform may integrate with or link to third-party services, tools, or websites. These are provided for convenience and are governed by their own terms and privacy policies. We don't control and aren't responsible for third-party content, availability, or practices.

Your use of any third-party service is at your own risk. We recommend reviewing their terms before use. If a third-party service disrupts your HostUnited services, we'll do our best to help, but we can't guarantee resolution of issues beyond our control.

Ending Your Membership

You may cancel your services at any time through your account dashboard. Upon cancellation, your data will be retained for 30 days, giving you time to retrieve anything you need. After this period, all data is securely and permanently deleted from our systems.

HostUnited may terminate services immediately in the event of a serious breach of these terms. Outstanding invoices remain due after termination. Provisions that naturally survive termination — including liability, indemnification, and intellectual property — continue in effect.

Dispute Resolution

If a disagreement arises, we'd like to resolve it through open conversation first. Either party may initiate by sending a written notice describing the concern. We'll work together in good faith for 30 days to find a solution.

If that doesn't work, the next step is mediation with a mutually agreed mediator in the Netherlands, with costs shared equally. If mediation doesn't resolve things within 60 days, either party may pursue formal proceedings in the competent courts of the Netherlands.

Changes to Terms

We may update these terms from time to time. When we do, we'll revise the "Last updated" date at the top of this page. For material changes that affect your rights, we'll provide at least 30 days' notice via email.

Continued use of our services after changes take effect constitutes acceptance. If you disagree with a change, please discontinue use before it becomes effective. We recommend reviewing these terms periodically.

Applicable Law

These terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms shall be submitted to the competent courts in the Netherlands. We encourage resolving disagreements through open communication before pursuing formal proceedings.

If any provision of these terms is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions remain in full force. Our failure to enforce a right does not constitute a waiver of that right.
